RE: The tariff classification of cut-out plate material from Mexico.

Dear Mr. Roser:

In your letter dated April 2, 2008 on behalf of your client, Collado Ryerson, you requested a tariff classification ruling.

The product to be imported consists of the residual material from the manufacturing of parts for earth moving machinery. Various pieces have been cut from nonalloyed steel plate using a computerized electric arc cutting machine. The cut steel that remains after this operation is similar to what remains after cookies have been stamped from dough.

The applicable subheading for the scrap steel plate material will be 7204.49.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for ferrous waste and scrap; remelting scrap ingots of iron or steel, other waste and scrap, other, other, cut plate and structural. The rate of duty will be free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
